THESE TERMS AND CONDITIONS OF SERVICE (the "Terms") ARE A LEGAL AND BINDING AGREEMENT BETWEEN YOU AND SONS OF NORWAY governing your use of Sons of Norway Marketplace (“Marketplace”). Please review the Terms fully before you continue to use Marketplace. By using Marketplace, you agree to be bound by the Terms. If you do not agree, please discontinue using Marketplace. These terms and conditions are subject to change without prior notice at any time, at Sons of Norway’s sole discretion. By visiting, browsing, shopping, accessing or otherwise using the Marketplace after a change has been posted, you accept the change. Please check these Terms and the Sons of Norway Privacy Pledge frequently for changes. Further you agree that Sons of Norway may, at any time and without notice and liability thereof, modify or discontinue use of Marketplace.

Your use and browsing of Marketplace is at your risk. If you are dissatisfied with any of the materials contained in Marketplace, with the quality of service or content, or with these Terms, your sole and exclusive remedy is to discontinue accessing and using Marketplace.

Sons of Norway shall not be liable for misinformation, typographical errors or misprints in the Marketplace.

Dealings with organizations and individuals and links to other websites and services

Furthermore, Marketplace may contain links to other websites, which are completely independent of Marketplace. Sons of Norway makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk. We neither control nor endorse such other websites, nor have we reviewed any content that appears on such other websites. You acknowledge and agree that we shall not be held responsible for the legality, accuracy, or inappropriate nature of any content, advertising products, Services or information located on or through any other websites or for the operation or policies of any such websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such websites or such content or other information.

Your interactions with organizations and/or individuals found on or through the Marketplace, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You agree that Sons of Norway shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Sons of Norway is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Sons of Norway, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service.

All requests for service and support stemming from dealings third party providers of goods or service should be made directly to such third party in accordance with their terms and conditions.

Limitations on service
Marketplace may be temporarily unavailable from time to time for maintenance or other reasons. Further, you acknowledge that Sons of Norway reserves the right at any time to modify or discontinue Marketplace (or any part thereof) with or without notice. Sons of Norway shall not be liable to you or to any third party for any modification, suspension or discontinuance of Marketplace.

Indemnification
You expressly agree that use of the Marketplace is at your sole risk. Neither Sons of Norway, nor any of its information or content providers, service providers, licensors, employees, or agents warrant that the Marketplace will be uninterrupted or error free, nor does Sons of Norway nor any of its information or content providers, service providers, licensors, employees, or agents warrant make any warranty as to the results to be obtained from use of the Marketplace. The Sons of Norway Marketplace Classifieds is distributed on an "as is" basis without warranties of any kind, either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability of fitness for a particular purpose or otherwise, other than those warranties which are implied by and incapable of exclusion, restriction, or modification under the laws applicable to this agreement. Neither Sons of Norway nor any of its information or content providers, service providers, licensors, employees, or agents shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the Marketplace.

As a user of Sons of Norway Marketplace, you agree to indemnify, defend, and hold harmless Sons of Norway; its affiliates and partners; and their respective officers, directors, employees, agents, members, licensors, representatives, and third party providers to the Marketplace from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any dealings with Marketplace advertisers.

These Terms and any other operating rules or terms currently posted on the Marketplace constitute the entire agreement between Sons of Norway and the users of Marketplace, and supersede all previous written or oral agreements between the parties with respect to such subject matter. No action of Sons of Norway may be construed as a waiver of any part of these Terms of Use. We may assign our rights and obligations under these Terms of Use and we shall be relived of any further obligation thereof.

These Terms shall be governed by and construed in accordance with the laws of the state of Minnesota. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state or federal courts located in Hennepin County, Minnesota and you thereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions herein.
